Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, your sole remedy is to stop using the Services.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Services, you consent to the collection, use, storage, and disclosure of information as described in the Privacy Policy.

All content, software, graphics, branding, logos, tournament systems, interfaces, technology, code, databases, designs, and other materials available through the Services (“Materials”) are owned by or licensed to Etourney LLC and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, reproduce, distribute, modify, reverse engineer, or create derivative works from the Services;
• Use Etourney trademarks without prior written consent;
• Exploit the Services for commercial purposes except as expressly authorized by Etourney.

All rights not expressly granted remain reserved by Etourney.

You agree that you will not:

• Violate any applicable law or regulation;
• Use the Services for unlawful gambling activities;
• Cheat, exploit bugs, use unauthorized software, bots, scripts, hacks, or automation tools;
• Harass, threaten, abuse, or impersonate others;
• Upload unlawful, defamatory, obscene, hateful, or infringing content;
• Attempt to gain unauthorized access to systems or accounts;
• Interfere with the operation or security of the Services;
• Use the Services to distribute malware, viruses, or harmful code;
• Engage in fraudulent tournament activity, match fixing, boosting, account sharing, or prize fraud;
• Create fake accounts or manipulate rankings or tournament outcomes.

Etourney reserves the right to suspend, terminate, or restrict access to any account for violations of these Terms or for conduct we determine to be harmful to the platform or community.

Etourney provides tools and infrastructure for tournament organizers and participants but is not the organizer, sponsor, or administrator of every event hosted on the platform.

Tournament organizers are solely responsible for:

• Tournament rules;
• Eligibility requirements;
• Prize distribution;
• Compliance with applicable laws;
• Event moderation and administration.

Etourney does not guarantee:

• The availability of tournaments;
• Prize payouts;
• Tournament fairness;
• Match outcomes;
• Continuous service availability.

Participation in tournaments is at your own risk.

You retain ownership of content you submit to the Services (“User Content”), including usernames, team names, tournament descriptions, chat messages, graphics, videos, and social content.

By submitting User Content, you grant Etourney a worldwide, royalty-free, transferable, sublicensable license to host, use, reproduce, display, distribute, and promote such content in connection with operating and marketing the Services.

You represent that you own or have the necessary rights to submit User Content.

The Services may integrate with third-party platforms, APIs, games, streaming services, payment providers, and social networks, including game publishers such as Riot Games, Valve Corporation, and Epic Games.

Etourney is not affiliated with or endorsed by any game publisher unless expressly stated.

Your use of third-party services is subject to their respective terms and policies.

If you believe content on the Services infringes your copyright, you may submit a DMCA notice including:

• Your contact information;
• Identification of the copyrighted work;
• Identification of the allegedly infringing material;
• A statement of good faith belief;
• A statement made under penalty of perjury;
• Your physical or electronic signature.

The Services are provided “as is” and “as available” without warranties of any kind.

To the maximum extent permitted by law, Etourney disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

Etourney does not guarantee:

• Uninterrupted service;
• Error-free operation;
• Tournament integrity;
• Prize delivery by third parties;
• Compatibility with all devices or games.

You use the Services at your own risk.

To the maximum extent permitted by law, Etourney LLC and its affiliates, officers, employees, contractors, and partners shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

In no event shall Etourney’s total liability exceed the greater of:

1. The amount you paid to Etourney in the six (6) months before the claim; or
2. $100 USD.

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

You agree to indemnify and hold harmless Etourney LLC and its affiliates, employees, officers, and partners from claims, damages, liabilities, losses, and expenses arising from:

• Your use of the Services;
• Your User Content;
• Your violation of these Terms;
• Your violation of any law or third-party rights.

Etourney may suspend or terminate your account or access to the Services at any time, with or without notice, for any reason, including suspected fraud, cheating, abuse, or violations of these Terms.

Upon termination, your right to use the Services immediately ceases.

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Washington State, and you consent to their jurisdiction.

By using the Services, you consent to receive communications electronically, including emails, notices, updates, and legal disclosures.
